Information on Personal Data

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 :
Regulation on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
The present "Information on Personal Data" is intended to inform students of the policy that the CNOUS adheres to in order to respect their Personal Data.
This « information » describes the methods used to manage Personal Data concerning students, natural persons, obtained during consultation or registration on the Cvec site. It relates only to the processing for which Les Crous is responsible.

Purpose of the processing

By Law n° 2018-166 of 8 March 2018 relating to student orientation and success (LORE), the Crous have been entrusted with the mission of collecting the Student Life and Campus Contribution (CVEC).

Prior to administrative registration at his or her institution, any student in initial training at a higher education institution must be exempted from the CVEC, either by payment or by exemption.

Nature of data processing

Aims : The processing allows :

• any student subject to the tax to be released by payment or waiver of the student life and campus life contribution,
• to generate the attestation of release of the student life and campus contribution that the student must produce when registering administratively at his or her institution and to allow institutions to control the attestation,
• to make any reimbursements under the conditions defined by the regulations,
• to reconcile the list of students enrolled in any higher education institution with the list of students who have been released from the contribution,
• manage the distribution of the proceeds of the Student Life Contribution to the beneficiary higher education institutions, on the basis of students enrolled and released from the Student Life Contribution.

Legal basis : This data processing falls within the scope of the public service mission entrusted to the CNOUS-CROUS network pursuant to Decree 2018-564 of 30 June 2018 relating to the contribution provided for in Article L.841-5 of the Education Code.

Article 6-e et 6-c of the General Data Protection Regulation - GDPR :
e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
c) processing is necessary for compliance with a legal obligation to which the controller is subject;

Processed data

Categories of data processed : Identification data, connection data, personal details and bank details.

Data Source : This information comes from the government student life portal (etudiant.gouv.fr), where it has been provided in advance by the student user of the Messervices.etudiant.gouv.fr portal.

In the case of reimbursement of the amount of the CVEC for a student who claims his or her right to exemption after payment, or for an individual who has paid when he or she is not liable, the bank details will be collected (BIC and IBAN) in order to proceed with the transfer to his or her bank account .

Mandatory nature of data collection : The Student Life and Campus Contribution Management Service provides, unless otherwise stated, for the mandatory collection of data necessary to process the application.

Automated decision making : With the exception of a possible exemption in view of conditional grant decisions for the coming academic year, the processing does not involve automated decision making.

Persons Concerned : The data processing concerns the natural persons concerned by the student life contribution

Recipients of Personal Data

Recipient categories

Depending on their respective needs, all or part of the data are recipients :

• The Crous are responsible for collecting the CVEC as set by law
• Universities and higher education institutions (exclusively the data mentioned on the CVEC certificate within a perimeter limited to the students who enrol in the institution)
• The supervisory authorities (ministry in charge of higher education).

Personal data collected by subcontractors of the CNOUS

The subcontractors are :

• For payment by credit card : PayFiP
• For cash payment : La Banque Postale - Eficash

They are responsible for implementing the appropriate collection processes.
The personal data required for payment are collected directly by the subcontractors from the user in compliance with the rules of the monetary and financial code.
Subcontractors' compliance with the General Data Protection Regulation (GDPR) has been verified.

Data transfer outside the EU

No transfer of data outside the European Union takes place.

Conservation of Personal Data

The information collected relating to the traceability of access is kept for one year. After this date, the data collected will be deleted.

The active processing base for the CVEC is purged of personal data every year at the beginning of the next campaign.

The personal data collected to issue a CVEC certificate are then archived for a period of five years for regulatory and internal control reasons.

Security

As data controller, the CNOUS implements the appropriate techniques and organisation to protect personal data, including load tests and security audits.

Your rights to your personal data

The student has a general right of access, rectification and deletion of all personal data concerning him/her that has been collected as part of his/her registration in order to benefit from the digital services offered by the portal. They also have the right to lodge a complaint with the CNIL.

• The right of access is granted either on the first visit to the CVEC site by displaying personal data on the home page or via "my profile" on the Messervices.etudiant.gouv.fr portal. It allows you to view the student's personal data at any time.
• Concerning the right of rectification, the "my profile" form on the MesServices portal allows certain data to be modified online when the student is authenticated. The modification of identity data and the INE requires a prior request via an online assistance form on the MesServices portal allows the student to make the request. Please refer to the information notices on the MesServices portal.
• The right to delete from the CVEC is subject to the need to prove that the CVEC has been paid (by payment or exemption) for the academic year and can only be deleted for the following academic year.

Exercising your rights with the personal data protection officer

The Crous have appointed their regional data protection delegate and are the relay of the Nous delegate to the students.
The Crous Data Protection Officer receives complaints from students concerned by the processing operations for which he has been appointed and ensures that students' rights are respected. He deals with these complaints or implements the appropriate procedures to ensure that they are dealt with properly.

The processing of Personal Data in the context of the exercise of your rights is personal and confidential. In this respect, in order for your request to be taken into account, you must send the elements necessary for your identification,namely

• a written statement on your honour certifying that you are the holder of the said Personal Data
• and a photocopy of an identity document

Crous' commitment to the processing of personal data

The Crous undertake to make every effort to ensure that the student's personal data :

• obtained and processed fairly and lawfully
• collected for specified, legitimate purposes and to limit their use to those purposes
• adequate, relevant and not excessive in relation to those purposes
• accessible and benefit from a right of rectification or deletion following a request sent by post or e-mail to the above-mentioned data controller
• retained in accordance with the purposes for which they were intended. The Crous undertake to implement the necessary means to ensure the security of data in order to prevent it from being damaged, modified, destroyed or communicated to unauthorised third parties.
